Breaking: Town Intends to Amend Zoning and General Plan for Rheem Theatre Property Development Swap

In potentially significant waiver of planning regulations, Town says it will amend zoning and general plan to allow 4-story apartment building if Theatre owner hands property over to specific organization.

On the town council agenda for next Wednesday, in addition to the storm drain tax discussion, is an item recommending approval of an MOU with the owner of the Rheem Theatre property.

Our quick read indicates:

The town expresses its willingness to amend zoning regulations and the general plan for an adjacent empty lot between the theater and town hall, in exchange for the theater owner transferring ownership of the theater property to the Moraga Community Foundation.

The current owner would build approximately 40 apartments in a 4-story building on the adjacent empty lot that is otherwise not zoned for that purpose.

Discussions appear to have been going on since at least January, when the town spent $4,118 in legal fees for this item.
